Lady Carr mentions mediation. Mediation has obvious advantages: it’s cheap, it doesn’t take up court/judges’ time, and is easy. My only experience of mediation is with the small claims court process. It was not a happy one – the information provided kept changing: first mediation had to be by phone, then it could be face-to-face, and then back to only by phone. And it basically seemed to boil down to a haggling process. What made me abandon it was when I was told ‘mediation is not concerned with questions of right and wrong. I was brought up believe that generally things were either right or wrong.
